OVERVIEW

These Terms of Service apply to your use of the Dead Curious Store website and to purchases made through it. In these terms, “we”, “us” and “our” refer to Dead Curious Store.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and services to you. Products may be manufactured and dispatched by an approved third-party fulfilment provider.

By using this website or placing an order, you agree to these Terms of Service, our Privacy Policy, Return and Refund Policy and Shipping Policy. Nothing in these terms limits your statutory consumer rights.

  1. USING OUR STORE

You must use this website only for lawful purposes. You must not:

• Attempt to interfere with the security or operation of the website
• Introduce viruses, malware or other harmful material
• Use the website fraudulently or impersonate another person
• Copy or commercially exploit store content without permission
• Infringe our intellectual property rights or those of another person
• Use automated systems to access the store in a way that damages, disrupts or places an unreasonable burden on it

We may restrict or suspend access where we reasonably believe these terms have been breached.

  1. CUSTOMER ACCOUNTS

You are responsible for ensuring that information provided through the store is accurate and current.

If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account. Contact us promptly if you believe your account has been accessed without permission.

  1. PRODUCTS

We take reasonable care to describe and display products accurately. Colours and appearance may vary slightly because of screen settings, manufacturing processes and differences between product sizes.

Many products are produced after an order is placed. Minor variations in print position, colour or scale may occur within normal manufacturing tolerances and are not necessarily defects.

Product descriptions, designs, prices and availability may be changed or discontinued. Changes will not affect orders that have already been accepted, except where required to correct an obvious error or where we agree a change with you.

  1. ORDERS AND CONTRACT FORMATION

Placing an order constitutes an offer to purchase the selected products.

After receiving your order, we will send an acknowledgement or confirmation by email. A contract is formed when we confirm that the order has been accepted or has entered production.

We may refuse or cancel an order where:

• Payment cannot be authorised
• A product is unavailable
• Pricing or product information contains an obvious error
• We reasonably suspect fraud, misuse or unauthorised resale
• We cannot deliver to the supplied address
• The order would breach applicable law or platform requirements

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

Please check product, size, colour, delivery and personalisation details carefully before submitting an order. Production can begin shortly after an order is accepted, so requested changes may not be possible.

  1. PRICES, TAXES AND PAYMENT

The price charged will be the price displayed and confirmed at checkout when the order is placed.

Delivery charges and any applicable taxes will be shown before the order is completed. Customers ordering from outside the product’s fulfilment region may be responsible for customs duties, import taxes or handling charges imposed by their country.

Payment must be authorised before an order can be processed. You confirm that you are authorised to use the payment method provided.

We may correct obvious pricing errors. If an error affects an order you have placed, we will contact you and give you the option to proceed at the correct price or cancel for a refund.

  1. PRINT-ON-DEMAND FULFILMENT

Our merchandise may be produced and dispatched by third-party print-on-demand fulfilment partners.

Providing customer and delivery information to these partners is necessary to manufacture, fulfil and deliver orders. The way personal information is handled is explained in our Privacy Policy.

The use of a fulfilment partner does not remove the consumer rights that apply to your purchase from Dead Curious Store.

  1. SHIPPING AND DELIVERY

Delivery estimates and charges are displayed at checkout or described in our Shipping Policy.

We will take reasonable steps to deliver within the stated timeframe. Delays may occasionally arise because of production demand, carrier disruption, customs processing, severe weather or circumstances outside our reasonable control.

Unless a different timeframe has been agreed, eligible UK consumer orders will be delivered within 30 days as required by applicable law.

For consumer orders, responsibility for the goods remains with us until they are delivered into your physical possession or the possession of a person you identified to receive them, except where you independently arranged a carrier that we did not offer.

Contact us if an order appears lost, arrives damaged or has not arrived within the expected delivery period.

  1. CANCELLATIONS, RETURNS AND REFUNDS

Cancellation, return and refund requests are handled according to our Return and Refund Policy, which forms part of these terms.

Eligible UK and European customers generally have the right to notify us that they wish to cancel an online purchase within 14 days of receiving it, without giving a reason. Applicable exceptions include products made to a customer’s individual specifications or clearly personalised.

Standard Dead Curious designs are not treated as personalised merely because they are printed after an order is placed.

Nothing in these terms or our Return and Refund Policy limits legal remedies for products that are faulty, damaged, not as described or not fit for purpose.

  1. PERSONALISED PRODUCTS

Where we offer a product customised with a customer’s name, wording, photograph or other individual instructions, the customer is responsible for checking the supplied information.

The customer confirms that they have permission to use any text, artwork, image, logo or other material submitted for personalisation.

We may reject material that is unlawful, abusive, defamatory, discriminatory, obscene or infringes another person’s rights.

Personalised products may be exempt from change-of-mind cancellation rights, but this does not affect rights relating to faulty, damaged or misdescribed goods.

  1. INTELLECTUAL PROPERTY

Unless stated otherwise, the branding, logos, artwork, graphics, text, photographs and store design displayed through the website are owned by or licensed to Dead Curious Store.

You may use the website for personal, non-commercial shopping purposes. You must not reproduce, distribute, sell, modify or commercially exploit our content without prior written permission.

Third-party names, platforms, trademarks and services remain the property of their respective owners.

  1. REVIEWS AND CUSTOMER CONTENT

If you submit a product review, photograph, comment or other content, you confirm that:

• The content is accurate and based on your genuine experience
• You own it or have permission to submit it
• It does not infringe another person’s rights
• It is not unlawful, abusive, defamatory, misleading or obscene
• Any incentive or compensation connected with the review has been disclosed

You grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and use submitted content in connection with operating and promoting the store.

We may remove content that breaches these terms or applicable law.

  1. THIRD-PARTY SERVICES AND LINKS

The store may use services or contain links operated by third parties, including payment processors, delivery providers, fulfilment partners and social platforms.

Third-party websites are governed by their own terms and privacy policies. We are not responsible for unrelated content or services offered directly by those third parties.

  1. SHOPIFY

The store is powered by Shopify. Purchases made through Dead Curious Store are transactions with Dead Curious Store and not with Shopify.

Shopify provides the ecommerce platform but is not the seller of the products offered through this store.

  1. PRIVACY

Personal information is handled in accordance with our Privacy Policy.

Information required to process an order may be shared with Shopify, payment providers, fulfilment partners and delivery companies. Information may be processed in countries outside the customer’s country of residence where permitted by applicable data-protection law.

  1. WEBSITE AVAILABILITY AND ERRORS

We aim to keep the website accurate and available, but we do not guarantee uninterrupted or error-free access.

We may correct errors, update information or temporarily suspend parts of the website for maintenance, security or operational reasons.

These provisions do not affect orders that have already been accepted or any rights that cannot legally be excluded.

  1. LIABILITY

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Breach of applicable statutory consumer rights
• Any other liability that cannot legally be excluded or limited

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

If you use the products or website for business purposes, our liability will be limited to the fullest extent permitted by law.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for failure or delay caused by circumstances outside our reasonable control.

Where such an event materially affects an accepted order, we will take reasonable steps to minimise disruption and keep you informed. Your legal rights relating to delayed or undelivered goods remain unaffected.

  1. TERMINATION

We may suspend or terminate access to the website where these terms have been materially breached.

Termination does not affect rights, obligations or payments that arose before termination. Provisions relating to intellectual property, liability, privacy and governing law will continue where appropriate.

  1. SEVERABILITY

If any part of these terms is found to be unlawful or unenforceable, that part will be treated as removed or limited to the minimum extent necessary. The remaining provisions will continue to apply.

  1. ENTIRE AGREEMENT

These terms, together with the policies referenced in them and the information confirmed at checkout, form the agreement between you and us concerning your purchase.

Nothing in this section limits liability for fraud or removes rights that cannot legally be excluded.

  1. CHANGES TO THESE TERMS

We may update these terms when our products, services, fulfilment arrangements or legal obligations change.

The terms applying to an order are normally those in force when that order is placed. Material changes will not retrospectively remove rights relating to an accepted order.

  1. GOVERNING LAW

These terms are governed by the laws applicable in the part of the United Kingdom where the business is established.

If you are a consumer, you retain any mandatory protections provided by the law of the country in which you normally live. You may bring proceedings in the courts available to you under applicable consumer law.
